Electronic Communications Consent

Effective Date: February 1, 2026

By accepting this Electronic Communications Consent during your Medesto Pulse registration, you authorize Medesto Health, LLC. (“Medesto Health,” “we,” “us,” or “our”) to send you electronic communications related to your healthcare through the channels described below. This consent applies to all electronic communications sent in connection with your use of the Medesto Pulse platform and the healthcare services facilitated through it.

This consent is provided in accordance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Health Insurance Portability and Accountability Act (HIPAA), and all applicable state and federal regulations governing electronic communications and the transmission of protected health information (PHI). By providing your consent, you acknowledge that you have read and understood the terms set forth herein and that you voluntarily agree to receive electronic communications as described in this document.

1. Introduction

By accepting this Electronic Communications Consent during your Medesto Pulse registration, you authorize Medesto Health, LLC. to send you electronic communications related to your healthcare through the channels described below. This consent applies to all electronic communications sent in connection with your use of the Medesto Pulse platform and the healthcare services facilitated through it.

This consent is provided in accordance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Health Insurance Portability and Accountability Act (HIPAA), and all applicable state and federal regulations governing electronic communications and the transmission of protected health information (PHI). By providing your consent, you acknowledge that you have read and understood the terms set forth herein and that you voluntarily agree to receive electronic communications as described in this document.

2. Communication Channels

You consent to receive communications from Medesto Health and your healthcare providers through the following channels. Each channel serves a specific purpose in facilitating your care and ensuring the secure operation of your Medesto Pulse account.

Medesto Pulse In-App Notifications

The Medesto Pulse application serves as the primary secure channel for healthcare communications. You may receive the following types of in-app communications:

  • Push notifications and in-app messages from your care team
  • Health feed updates, including care instructions and clinical notes
  • Appointment reminders, confirmations, and scheduling notifications
  • Electronic document signature requests (e.g., consent forms, care agreements)
  • Video call notifications and telehealth consultation invitations
  • Checklist and task reminders related to your care plan
  • Prescription shipment tracking and delivery updates

SMS / Text Messages

You consent to receive SMS and text messages at the mobile phone number you provide during registration or subsequently update in your account settings. These messages may include:

  • Appointment reminders and scheduling confirmations
  • Medication reminders and refill notifications
  • Urgent care team communications requiring your prompt attention
  • Account security alerts (e.g., login attempts from unrecognized devices)
  • Two-factor authentication (2FA) verification codes

Standard message and data rates may apply. Message frequency varies based on your care plan and healthcare activity. You may receive multiple messages per day during active care periods.

Email Communications

You consent to receive email communications at the email address you provide during registration or subsequently update in your account settings. These emails may include:

  • Account registration confirmations and security notifications
  • Appointment confirmations, reminders, and rescheduling notices
  • Care plan updates and health education resources
  • Platform updates, maintenance notices, and service announcements
  • Billing statements, payment confirmations, and payment reminders
  • Responses to your inquiries and support requests

Phone Calls

You consent to receive phone calls at the phone number(s) you provide during registration or subsequently update in your account settings. These calls may include:

  • Automated and live appointment reminders
  • Urgent healthcare communications from your provider or care team
  • Follow-up calls regarding your treatment, care plan, or recent visits
  • Account security verification calls

Calls may be recorded for quality assurance and training purposes. You will be notified at the beginning of any call that is being recorded.

3. Types of Communications

The electronic communications you may receive through the channels described above include, but are not limited to, the following categories:

  • Appointment scheduling, reminders, confirmations, and cancellation notices
  • Medication reminders, dosage instructions, and prescription refill notifications
  • Lab results and diagnostic test notifications
  • Care instructions, discharge summaries, and treatment plan updates
  • Health education materials and wellness information relevant to your care
  • Prescription shipment tracking and delivery notifications
  • Electronic document signing requests, including consent forms and care agreements
  • Video consultation invitations and telehealth session notifications
  • Billing statements, payment reminders, and payment confirmation receipts
  • Account security alerts, password reset notifications, and login verification codes
  • Platform updates, new feature announcements, and service maintenance notices
  • Patient satisfaction surveys and feedback requests

We will not send marketing or promotional messages that are unrelated to your healthcare or the services provided through the Medesto Pulse platform.

4. Frequency of Communications

The frequency of communications you receive will vary based on your individual healthcare needs, the activity level of your care plan, and the engagement of your healthcare providers. During periods of active care, such as following an appointment, procedure, or hospitalization, you may receive multiple communications per day across various channels.

During routine care periods, communication frequency is typically lower and may include periodic appointment reminders, medication reminders, and general wellness check-ins. Your healthcare provider’s communication patterns and your specific care plan will be the primary factors determining how often you receive messages.

5. Data Charges and Costs

Important: Standard message and data rates may apply for SMS/text messages you receive from Medesto Health. You are responsible for any charges imposed by your wireless carrier for receiving text messages and data transmissions. Medesto Health does not charge any fees for sending communications to you, but your mobile carrier’s standard messaging and data rates will apply. Please contact your wireless carrier for details about your messaging plan and any associated costs.

If you are concerned about data charges, you may opt out of SMS communications and rely on in-app notifications and email communications instead, which typically do not incur per-message charges from your carrier. Wi-Fi connectivity can be used to access Medesto Pulse in-app notifications without incurring mobile data charges.

6. Your Right to Opt Out

You may opt out of specific communication channels at any time while continuing to use the Medesto Pulse platform, subject to the limitations described below. The following opt-out methods are available for each channel:

SMS / Text Messages

Reply STOP to any text message received from Medesto Health to immediately cease receiving SMS communications. Alternatively, you may update your communication preferences in your Medesto Pulse account settings under the “Notifications” section. Upon processing your opt-out request, you will receive a single confirmation message acknowledging your request. Reply HELP to any text message to receive program information and our support contact details.

Email Communications

Click the “Unsubscribe” link included at the bottom of any email communication from Medesto Health. You may also update your email communication preferences in your Medesto Pulse account settings. Opt-out requests for email communications will be processed within ten (10) business days, as required by the CAN-SPAM Act.

Phone Calls

Request removal from automated call lists by contacting our support team at support@medestohealth.com or by calling (734) 855-6739. You may also update your phone call preferences in your Medesto Pulse account settings.

In-App Notifications

Manage push notification preferences through your device’s operating system notification settings or through the notification preferences section within the Medesto Pulse application.

Please Note: Certain communications related to account security, legal notices, and critical health alerts cannot be opted out of while your Medesto Pulse account remains active. These include, but are not limited to, two-factor authentication codes, account security alerts, critical medication warnings, urgent care team messages, legal and regulatory notices, and changes to our terms of service. These communications are essential for the safe operation of your account, the protection of your personal health information, and the delivery of healthcare services.

7. Required Consent

This consent to receive electronic communications is a required condition of using the Medesto Pulse platform. The Medesto Pulse platform is specifically designed to facilitate timely and secure communication between you and your healthcare providers. The platform cannot function as intended without the ability to deliver essential communications to you regarding your care, appointments, medications, and account security.

If you do not wish to receive electronic communications as described in this consent, you will not be able to register for or continue to use the Medesto Pulse platform. In such cases, your healthcare provider can arrange alternative communication methods outside of the Medesto Pulse platform to ensure continuity of your care.

Important: Your decision not to consent to electronic communications will not affect your ability to receive healthcare services from your provider. Alternative communication arrangements (such as postal mail or in-person communications) can be made directly with your healthcare provider’s office.

8. Privacy and Security

All electronic communications sent through or in connection with Medesto Pulse are handled in strict accordance with our Privacy Policy, our HIPAA Consent, and all applicable federal and state privacy regulations. We are committed to protecting the confidentiality, integrity, and security of your protected health information (PHI) across all communication channels.

The following security measures are in place to protect your information:

  • PHI transmitted through the Medesto Pulse application is protected by end-to-end encryption and secure authentication protocols.
  • SMS and email communications are designed to minimize the exposure of sensitive health information. These channels are used primarily for reminders, alerts, and notifications that do not contain detailed clinical information.
  • Detailed health information, including lab results, clinical notes, and treatment plans, is delivered through the secure Medesto Pulse application rather than via SMS or email whenever possible.
  • All data transmissions comply with HIPAA security standards and industry best practices for the protection of electronic health information.
  • Phone calls involving discussion of PHI are conducted in accordance with HIPAA privacy requirements.

9. Updating Your Contact Information

It is your responsibility to ensure that your contact information remains current and accurate at all times. Outdated or incorrect contact information may result in missed healthcare communications, including appointment reminders, medication alerts, and urgent messages from your care team.

You can update your phone number, email address, and other contact information at any time through the following methods:

  • Updating your profile settings directly within the Medesto Pulse application
  • Contacting your healthcare provider’s office and requesting a contact information update
  • Contacting Medesto Health support at support@medestohealth.com or (734) 855-6739

Medesto Health is not responsible for communications that are undelivered or delivered to the wrong recipient as a result of outdated or inaccurate contact information that you have not updated.

10. Revocation of Consent

You have the right to revoke this Electronic Communications Consent in its entirety at any time. To revoke your consent, you may use any of the following methods:

  • Send an email to support@medestohealth.com with the subject line “Revoke Electronic Communications Consent”
  • Call our support team at (734) 855-6739 and request revocation of your electronic communications consent
  • Submit a written request by mail to: Medesto Health, LLC., 17177 N. Laurel Park Dr., Suite 164, Livonia, MI 48152

Important: Please be advised that revoking this Electronic Communications Consent will result in the deactivation of your Medesto Pulse account, as the platform cannot function without the ability to communicate with you electronically. Revocation does not affect any communications that were sent prior to the date your revocation request was processed. We will process your revocation request within a reasonable timeframe, typically within ten (10) business days of receipt.

If you revoke this consent and your account is deactivated, your healthcare provider will be notified and can make alternative communication arrangements to ensure continuity of your care. You may re-consent to electronic communications at any time by re-registering for the Medesto Pulse platform.

11. Changes to This Consent

Medesto Health reserves the right to update or modify this Electronic Communications Consent at any time to reflect changes in our communication practices, technological capabilities, or applicable legal and regulatory requirements. We will notify you of any material changes through one or more of the following methods:

  • An in-app notification within the Medesto Pulse application
  • An email to the address associated with your account
  • A prominent notice posted within the Medesto Pulse platform

The updated consent will include a revised “Effective Date” at the top of the document. Your continued use of the Medesto Pulse platform after the effective date of any updated consent constitutes your acceptance of the revised terms. If you do not agree with any changes, you may revoke your consent as described in Section 10 above.

13. Acknowledgment

By accepting this Electronic Communications Consent during your Medesto Pulse registration, you acknowledge and confirm that:

  • You consent to receive electronic communications from Medesto Health and your healthcare providers through the channels described in this document, including in-app notifications, SMS/text messages, email, and phone calls.
  • You understand that standard message and data rates may apply for SMS/text messages and that you are responsible for any charges imposed by your wireless carrier.
  • You understand how to opt out of specific communication channels and that certain essential communications cannot be opted out of while your account remains active.
  • You understand that this consent to receive electronic communications is a required condition of using the Medesto Pulse platform.
  • You understand your right to revoke this consent at any time and that doing so will result in the deactivation of your Medesto Pulse account.
  • You have read, understood, and voluntarily agree to the terms of this Electronic Communications Consent.
